Reclame Richtlijnen Vs Links In 2011

De Britse ASA , te vergelijken met onze Nederlandse Reclame Code Commissie, gaf vorige week desgevraagd door eConsultancy aan dat ze ook zoekmachine optimalisatie en affiliate marketing als reclame zouden beschouwen, en er dus ook hun regels op toe zouden passen. Dat heeft interessante gevolgen, die misschien ook wel voor Nederland gelden, als je kijkt naar de nieuwe definitie van reclame zoals onze Nederlandse Reclame Code commissie die per 1 januari 2011 gaat hanteren:
Onder reclame wordt verstaan: iedere openbare en/of systematische directe dan wel indirecte aanprijzing van goederen, diensten en/of denkbeelden door een adverteerder of geheel of deels ten behoeve van deze, al dan niet met behulp van derden. Onder reclame wordt mede verstaan het vragen van diensten.
In de uitleg geeft ook de RCC aan dat onder andere buzz marketing en affiliate marketing nu onder deze richtlijnen vallen. Europa is wat laat in deze, in de VS was verplichte disclosure van dit soort zaken al eerder vereist , en daar zelfs door een overheidsinstantie met rechtsgeldige regelgeving
Bas van den Beld schreef hier al eerder over de Code Social? , maar dit voert het volgens mij nog een stap verder. Social of niet: affiliates en SEO's zitten immers overal.
Simpel: van een link waarvoor betaald is, moet duidelijk zijn dat dat zo is? Immers, zie artikel 11.1 van de Nederlandse Reclame Code :
Reclame dient duidelijk als zodanig herkenbaar te zijn, door opmaak, presentatie, inhoud of anderszins, mede gelet op het publiek waarvoor zij is bestemd.?
Dus een affiliate link moet als zodanig bekend worden gemaakt, als gevolg van deze nieuwe definitie van reclame, maar ook, en hier wordt het voor SEO interessant, betaalde links. Althans, zo interpreteert men het in de UK. Mijns inziens zou dat ook in Nederland het geval moeten zijn (let wel: ik ben geen jurist), waarmee het kopen van links met als doel het beter ranken in de zoekmachines voor partijen die zich iets aan de Reclame Code Commissie gelegen laten liggen nog lastiger wordt.
Google stond natuurlijk het kopen van links al langer niet toe, zie deze twee artikelen hier op MF, maar Google vraagt enkel? om een zogenaamd nofollow attribuut, wat absoluut niet betekent dat ook de consument kan zien dat die link gekocht? is. Dus een link die volgens de richtlijnen van Google OK? is, kan dat wel eens niet volgens de reclame richtlijnen in de UK zijn, en vice versa.
Ook voor affiliates en startpagina's kan dit nogal wat veranderen, mocht het ook in Nederland zo gaan werken. Ik verwacht dan bijvoorbeeld dat adverteerders zullen gaan vereisen dat affiliates aan hun bezoekers duidelijk maken dat het om reclame gaat. Of dit goed zal zijn voor de conversie? Dat gaat de toekomst leren. Voor de pessimisten: Chris Brogan gaf toen de regelgeving in de VS van kracht werd het al aan: I love disclosure ?.
Persoonlijk hoop ik dat ik gelijk krijg, en dat we in Nederland ook daadwerkelijk op deze manier met de richtlijnen om zullen gaan. Maar ik ben eigenlijk vooral erg benieuwd wat jullie er van vinden en denken!
Persoonlijk vind ik de regelgeving nog niet eens het meest spannende, maar ben ik vooral benieuwd naar de handhaving ervan. Dat lijkt me een vrijwel onmogelijke klus. Bij affiliatemarketing is het nog wel 'aantoonbaar' affiliate marketing blog by shawn collins te maken dat het om gekochte links gaat, dat wordt bij directe deals (bijv. links die zijn gekocht) een stuk moeilijker. Het zou ook gaan om commerci?le links via Twitter. Lijkt me ook een moeilijk verhaal.
Zolang consumenten nog niet eens het verschil zien tussen organische links en Adwords links in Google zie ik geen grote problemen. Handhaving lijkt me idd wel heel lastig, zoals Wieger zegt. Maar wie weet, komt de overheid met het geweldige DPI filter waardoor het ineens wel mogelijk is. En krijgen we straks allemaal een chip in onze bovenarm. Weer een stukje burgervrijheid weg. Wie had ook alweer bepaald dat de overheid er voor de burger is en niet andersom?
Hoe meer duidelijkheid, hoe meer consumentenvertrouwen. Daarnaast denk ik dat als je selectief met je affiliatelinks etc omgaat, je een meerwaarde kunt bieden voor de klant die je site/blog/whatever of jouzelf een bepaalde autoriteit toekent.
Brogan doet dat inderdaad heel mooi door te vermelden WAAROM ie links plaatst van anderen. Een mooi voorbeeld!
Interessante ontwikkelingen, maar de vraag is wel hoe ver je wil gaan. Als op een site een aanbieding staat "Ontvang nu 6 weken NRC voor maar ? 9,95" moet daar dan een DIT IS RECLAME voor? Of wanneer een affiliate door middel van datafeeds producten toont op de website moet er dan bij de bestel knop of "ga naar shop" button ook een melding LET OP: SITE VERDIENT HIER AAN.
Je mag blij zijn dat je niet in duitsland woont waar iedereen je gewoon een 'abmahnung' kan 'schicken' en je zo aansprakelijk kan stellen voor het gerecht. Daarbij lijkt het mij inderdaad dat dit alleen maar kan bestraft worden bij voldoende bewijslast, maar met stukje omgekeerde bewijslast opname in de wet, is dat zo heel anders.
Kortom: als je in de kijker loopt ben je ms een keer aan de beurt, anders hoef je je geen zorgen te maken en zoals de waard is, vertrouwd hij zijn gasten...
@yoast Tnx voor de onderbouwing, openheid is ook vaak prima. Vind zelf wel dat er een (groot) verschil is tussen een blog en een aanbiedingen- of prijsvragenpagina. Zouden vergelijkers dan ook bij elke link en button moeten zetten dat het om een commerci?le link gaat?
Wellicht ja, zeker in gevallen waar content en commercie door elkaar heen lopen. Dus bij een linkpagina waar de helft van de links staat vanwege de kwaliteit en de andere helft omdat er voor betaald is.
Bij vergelijkers bij elke link vermelden dat er voor betaald is, gaat mij echt te ver. Dat is hun hele businessmodel en hoewel sommige (of de meeste) consumenten misschien zullen denken dat het de Robin Hood's van deze wereld zijn is een beetje common sense wat mij betreft wel op z'n plek. Op TV hoor je toch ook niet voor elke reclamespot "Dit is reclame, hier is voor betaald".
Ik zeg ook niet dat het bij elke reclame moet, dat staat er ook niet, het moet duidelijk zijn voor de consument dat het reclame is. Overigens ook nu al wettelijk wel het een en ander over te zeggen, van de Wikipedia pagina over sluikreclame:
"Op grond van art. 6 van de Richtlijn Elektronische handel moeten commerci?le communicaties al duidelijk herkenbaar zijn. De Richtlijn Elektronische handel bevat geen expliciet verbod van sluikreclame, zoals de Televisierichtlijn en haar opvolger, maar het fenomeen sluikreclame staat op gespannen voet met de eis van herkenbaarheid. Bovendien moet op grond van art. 6 van de Richtlijn Elektronische handel duidelijk zijn op wiens rekening reclame wordt gemaakt. Dat is bij sluikreclame niet het geval, zodat sluikreclame onder de Richtlijn Elektronische evenmin toelaatbaar is.?
Tja en zoals met alles in dit land: we verzinnen de wereld aan regeltjes om het verzinnen lijkt het wel... en wie gaat dit nou weer controleren? De link politie? Zucht!

As per Note 34.3 (Market value of financial instruments?), the entire balance was stated at its fair value, this because the notes for marketable securities, investments, and other securities states that The market value of securities is determined based mainly on the market price or the prices available on other similar securities.? In practice the investments accounted for FVPL are reported at its fair value in the balance sheet.
As per Note 34.4 (Valuation methods for financial assets and liabilities at their fair value?), out of $951 million $31 million was estimated using level 1 inputs and balance $920 million was estimated using level 2 inputs. Even though level 2 fair value estimates are less reliable than level 1, but market-based inputs are better. Still this fair value estimate is less reliable in comparison to level 1 in the fair value hierarchy.
As per Note 24 of the disclosure notes of AFK company for the year ended December 31, 2013 (Other financial assets?), the balance of investments accounted for as available for sale was $1,135 million (including Shares secured? portion). This balance of $1,135 million is consolidated in the total of $1,963 million and reported as other financial assets? in the balance sheet.
As per Note 24 and the balance sheet the investment accounted for as available-for-sale, affiliate marketing and facebook ads the entire balance of $1,135 million was classified as noncurrent.
As per Note 34.3 (Market value of financial instruments?), the entire balance is reported at its fair value in the balance sheet, since the note states, Assets available for sale are recorded at their stock market value.? Besides it a common practice that investments accounted for as available-for-sale are reported at its fair value in the balance sheet.
As per Note 34.4 (Valuation methods for financial assets and liabilities at their fair value?), out of $1,135 million, $1,100 million was estimated using level 1 inputs while the balance $35 million was estimated using level 2 inputs. Since level 1 inputs fair value estimation is most reliable, this fair value estimate must be very reliable.
When the AFK Company could exercise significant influence over the investee, the company uses the equity method to account for the investment. When AFK Company could own more than 20% of the voting rights of the investee, the company could exercise significant influence.
When AFK Company exercises joint control over an investee, the company uses equity method to account for the joint ventures.
As per Note 22 (Equity affiliates?) and the balance sheet, the carrying value of the equity-method investment of AFK Company in its balance sheet for the year ended December 31, 2013 was $177 million.
As per Note 22 and the income statement, the net income from continuing operations of AFK Company for the year 2013 was reduced by 211 million by the equity-method investments.
